1. Acceptance of the Terms

By downloading, accessing, or using WellUp, you agree to these Terms of Use and to the app's Privacy Policy, which is an integral part of these Terms. If you do not agree, do not use the app.

2. What WellUp is

WellUp is a health, nutrition, and training tracking app that lets you:

• record health data (weight, measurements, body composition, lab exams, posture assessments, supplement and medication protocols, daily metrics);
• plan and log nutrition (meals, recipes, meal plans) and workouts (routines, sessions, loads);
• use artificial intelligence (AI) assisted features, such as extracting data from exam PDFs, diet and workout suggestions, and photo analysis;
• optionally connect — under your control — with a professional (nutritionist, personal trainer, or other) who follows your data.

The app offers two usage modes: user (a person tracking their own data) and professional (a person following clients, upon those clients' invitation and consent).

3. Important notice: WellUp is not a medical service

• Content shown in the app — including calculations (BMR, TDEE, BMI, calorie targets), AI-generated suggestions, exam reference ranges, and indicators — is informational and descriptive in nature.
• No information in the app replaces consulting physicians, dietitians, fitness professionals, or other licensed practitioners. Always consult a professional before starting any diet, training program, supplementation, or protocol.
• Logging supplements, medications, or other substances in protocols is a personal note-taking feature: it does not constitute a prescription, recommendation, or encouragement to use any substance.
• In an emergency or if you have serious symptoms, seek medical care immediately. Do not use the app for urgent situations.

4. Artificial intelligence features

• Some features use AI to generate suggestions and extract information (e.g., reading exam PDFs, analyzing body composition reports and meal photos, suggesting diets and workouts, posture analysis).
• AI outputs are drafts/suggestions and may contain errors or inaccuracies. They are only saved after your confirmation (or that of an authorized professional) and should always be reviewed before any decision.
• The company does not warrant the accuracy, completeness, or fitness of AI-generated outputs for any particular purpose.

5. Professionals on the platform

• The coaching relationship (nutritional, training, or other) is established directly between you and the professional. The company is not a party to that relationship and is not responsible for the professional's services, guidance, or conduct.
• It is your responsibility to verify a professional's credentials and qualifications before granting access to your data.
• If you act as a professional in the app, you represent that you are legally qualified for the activities you perform, that your showcase information is truthful, and that you will handle your clients' data confidentially and in accordance with applicable law (including data protection laws) and your professional board's rules.

6. Sharing data with professionals

• Sharing always requires your acceptance — whether you link to a professional yourself or they send you an invitation.
• You choose per-module permissions (training, nutrition, health) with access levels (none, view, edit), and you can change or revoke them at any time, with immediate effect.
• A professional with edit permission may create records on your behalf (e.g., a diet or a workout routine); these records identify their author.

7. Registration and account

• Using WellUp requires an account, created through social login (Google or Apple).
• You must provide truthful information and keep it up to date.
• You are responsible for the security of your sign-in method (your Google/Apple account) and for activity carried out in your account.
• The app is intended exclusively for adults 18 or older. By creating an account, you represent that you are 18 or older. We do not offer any parental consent mechanism and do not allow account creation by anyone under 18. If we identify an account belonging to someone under 18, it will be deleted, as described in the Privacy Policy.
• This restriction applies to creating an account in the app. A qualified professional may follow patients under 18 as managed patients — with no account and no app access for the minor — in which case the relationship with the patient and their legal guardians, along with any required authorizations, is the professional's responsibility.

8. Plans, subscriptions, and payments

• WellUp offers a free plan with usage limits and paid subscription plans (e.g., Premium and professional plans), with monthly or quarterly periods. Current features, limits, and prices are shown in the app and in the store.
• Subscriptions are processed exclusively by the stores (Apple App Store and Google Play). The company does not collect or store full payment card data.
• Subscriptions auto-renew: they renew at the end of each period for the same term unless canceled at least 24 hours before the end of the current period, through the subscription settings of your Apple/Google account.
• Where offered, a free trial automatically converts into a paid subscription at its end unless canceled before the trial ends. Any unused portion of a free trial may be forfeited when a purchase is confirmed.
• Billing, renewal, cancellation, and refunds follow the rules of the store where the subscription was purchased.
• Deleting your account does not cancel active subscriptions. Cancellation must be done directly in the store (Apple/Google).

Sponsorship credits

• Professionals can purchase sponsorship credits — a one-time purchase with no auto-renewal — to cover the Premium access of clients in their professional roster. Each credit is worth 1 month of Premium granted to a linked client chosen by the professional.
• Sponsorship credits are not refundable by WellUp once used.

9. Health integration (Apple Health / Health Connect)

• Optionally, the app can read data such as steps, distance, calories, sleep, weight, height, body fat percentage, and heart rate from Apple Health (iOS) or Health Connect (Android), and write exercise sessions, subject to your per-data-type authorization in the system.
• This data is used exclusively for the app's tracking features and never for advertising. You can revoke the authorization at any time in your device settings.

10. Content you upload

• You may upload content to the app (photos, exam PDFs, reports, meal images, professional profile media, and messages in the chat with your linked professional or client). You represent that you hold the necessary rights to that content.
• You grant the company a limited, non-exclusive, revocable license to store and process that content for the sole purpose of operating the service's features (including the AI processing described in the Privacy Policy).
• Uploading unlawful or offensive content, content that infringes third-party rights, or content unrelated to the app's purposes is prohibited.
• Chat messages can be reported by the other participant within the app, and ending the professional-client link blocks new messages between the parties. The company may remove content that violates these Terms and, in cases of abuse, terminate links or accounts.

11. Permitted use and prohibited conduct

You agree not to:

• violate applicable laws or use the app for unlawful purposes;
• attempt unauthorized access to restricted areas, third-party accounts, APIs, or systems;
• reverse engineer, run abusive automation, scrape improperly, or attempt fraud (including subscription and free-trial fraud);
• interfere with the app's security, stability, or operation;
• use the app to practice a licensed health profession without proper qualification.

12. Intellectual property

The interface, brand, code, content organization, exercise and food databases (where applicable), texts, and other elements of WellUp are protected by intellectual property rights belonging to the company or its licensors. These Terms do not transfer any ownership rights to you.

13. Availability and changes to the service

The app may undergo updates, feature changes, fixes, and maintenance. The company may change or discontinue features, in whole or in part, with notice in the app, in the store, or through official channels. Features that depend on third parties (stores, cloud, and AI providers) may experience outages beyond our control.

14. Limitation of liability

The app is provided "as is," with reasonable efforts toward availability and security. To the maximum extent permitted by law, STOCKLER X-SOLUCOES LTDA is not liable for:

• health, diet, training, or substance-use decisions made based on information in the app or on AI-generated suggestions;
• services, guidance, and conduct of professionals connected through the platform;
• temporary third-party outages, device/OS incompatibilities, or indirect damages arising from misuse of the app;
• inaccuracies in data automatically extracted from documents you upload (e.g., exam PDFs), which must always be reviewed.

15. Privacy and data protection

The processing of personal data — including sensitive health data — is described in the WellUp Privacy Policy, an integral part of these Terms.

16. Account deletion

You may delete your account at any time from within the app (Profile → Settings → Delete account). Deletion has a 30-day grace period during which it can be reversed; after that period, data is permanently erased, as detailed in the Privacy Policy and the Account Deletion page. Remember: deleting your account does not cancel active store subscriptions.

17. Changes to these Terms

These Terms may be updated periodically. The current version will show the effective date at the top of the document. Material changes may be communicated in the app.

18. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Rio de Janeiro / RJ, Brazil are elected as the venue, except where a different venue is legally mandated (including consumer protections and mandatory rules of your place of residence).
